The General Terms and Conditions of Service (hereinafter referred to as the General Terms and Conditions) of AGARIC, d. o. o., Tržaška cesta 23, 2000 Maribor (hereinafter AGARIC), are an integral part of all contracts concluded between AGARIC and the customer or another person (hereinafter the customer) who is in a legal business relationship with AGARIC. The provisions of these general terms and conditions also apply to all offers, pro forma invoices, legal business statements, and other legal business services arising from the business relationship between AGARIC and the customer.
AGARIC operates at the company headquarters: Tržaška cesta 23, 2000 Maribor. AGARIC also manages the following websites: agaric, agaricpromogifts, pisala.
These General Terms and Conditions hold precedent over and fully supersede any potential conflicting terms and conditions of the Customer or any other document issued by the Customer, unless AGARIC expressly agrees otherwise.
These general terms and conditions represent a contract or an integral part of the contracts (agreements) concluded between the Customer and AGARIC and are applicable to each Customer order. By signing the contract or otherwise entering a legal business relationship with AGARIC, the Customer fully agrees to the General Terms and Conditions. The party also expressly acknowledges that all legal relationships are governed exclusively by the contract and the General Terms and Conditions in question or by other General Terms and Conditions of AGARIC. The customer is obligated to accept the General Terms and Conditions in the form in which they are if he wants to cooperate and act in a legal business relationship with AGARIC.
These General Terms and Conditions apply in addition to all other regulations, including the regulations on consumer protection and protection of personal data. AGARIC processes personal data of subscribers / customers and user account holders in accordance with the applicable regulations of the Republic of Slovenia.
The General Terms and Conditions are published on the website and are also available at the AGARIC headquarters, whereby the customer is deemed to be fully acquainted with them.
The General Terms and Conditions are binding in form and content on the date of signing the contract.
Personal data when ordering
AGARIC collects personal data for the purposes of order processing, subscription, and sending the newsletter (promotional offers, information material, and news about new promotional and business gifts) if the customer has subscribed to the newsletter.
Based on these General Terms and Conditions, AGARIC collects and further processes the following personal data of the Customer, or the user account holder, designated by the Customer:
- Name and surname.
- E-mail address for receiving the newsletter.
- The following Customer data: date of placing the order and date of concluding the contract, data on payment of the ordered product/services, an e-mail address or a postal address for receiving invoices, name and surname or company name, address, and the tax number of the Customer.
- Other personal data that the subscriber or user account holder voluntarily provides to AGARIC.
The Customer is obligated to notify AGARIC of any changes that may affect the execution of the subscription relationship no later than 3 working days from the occurrence of the change. If the Customer waives the notification obligation, AGARIC shall fulfill its obligations correctly and validly based on the information at its disposal. The Customer shall be liable for any damages that may result from waiving the notification obligation under this paragraph.
Ordering and inquiry (legal entities)
The Customer can send a completely safe inquiry via our website and can rescind it at any time. The selection of items is done by clicking on the ADD TO INQUIRY LIST button, which is located next to each item in the detailed description. If the item has an option of choosing colors or sizes, the customer selects them after placing it on the inquiry list. A specific item can also be removed by clicking on the button.
The Customer can order a sample item. The Customer is charged the value of the sample, handling costs, and shipping costs (according to the price list of Post of Slovenia).
The person with the information as stated when placing the order is regarded as the Customer. It is not possible to change customer information at a later point. The sale is intended for legal entities, unless otherwise stated. Orders can be placed via the listed contacts on the websites managed by AGARIC, d. o. o. A presentation meeting with AGARIC, d. o. o, may be arranged at the request of the Customer.
The purchase process for legal entities is the same as for natural persons, except that in the first step the Customer selects the option “invoice to the company” and confirms to agreeing with the terms of business.
If the Customer wants the invoice to be issued to the company name, the Customer accepts the terms of business that apply to companies. The main difference is in the possibilities of withdrawing from the contract: we enable companies, sole proprietors, and other legal entities to return delivered items within the terms of warranty conditions. The aforementioned legal entities do not have the option to withdraw from the contract within 14 days after receiving the item for no reason, as is the case for regular consumers (natural persons).
The order is confirmed no later than 24 hours after receiving the order and the confirmation is sent to the Customer by e-mail which includes the approximate delivery date.
Rebates, promotions and prices
A resale discount can be set with all interested legal entities, depending on the quantity of the ordered goods. Possible discounts apply to pre-orders, orders in large quantities for the end Customer, and payments by proforma invoice.
All prices are listed without VAT, unless otherwise stated. If the pro forma invoice for the goods is not paid for, the order becomes binding for the seller upon the receipt of the payment assurance instrument. The type and method of securing the payment is up to the discretion of AGARIC, d. o. o. The ordered and delivered goods remain the property of the seller until they are paid for in full. In the event of a late payment, statutory late payment fees will be charged.
The prices in the price list do not include printing, embroidery, engraving, or special packaging, which are the subject of a special offer, which depends on the type of products, quantity, number of colors, process, etc. When ordering 100 pieces of products or more the products can be equipped with a hanger with a logo at the request of the customer. In this case, send the logo in vector format and the color number according to the pantone color scale to the AGARIC e-mail address. If the logo is not in vector format, the design of the logo is additionally charged. The cost of preparation for printing and the actual printing (screen printing, pad printing, embroidery, laser engraving…) must be added to the costs of the purchased goods. The printing costs are charged individually and are calculated depending on the printing technique, color palette, and quantity of prints.
Delivery of ordered goods
The delivery time for the ordered goods is stated separately in each offer. When ordering a print, the delivery time is extended by the time required for printing - that is approximately up to ten working days. The customer is informed that a minor deviation in color, dimensions, or material of the goods is permitted when compared to the catalog. AGARIC, d. o. o. delivers the ordered goods to the customer by mail. Delivery costs are covered by the customer according to the valid price list of Pošta Slovenije, unless otherwise stated in the offer.
The ordered goods are delivered quickly, safely, and reliably by our contractual partners POŠTA SLOVENIJE and DPD. For purchases over EUR 250.00 the postage is free and a flat-rate postage of EUR 5.00 is charged for smaller purchases for delivery in Slovenia. The price for shipments to other countries is stated when the country is entered during the ordering process. A packaging fee is not charged unless explicitly stated.
In case of problems with the delivery of the shipment or any potential damage to the package, the customer should contact the delivery company (POŠTA SLOVENIJE or DPD). It is recommended that the customer also informs AGARIC, d. o. o.
All products will be shipped as soon as possible. For goods which are in stock delivery within 2-7 workdays is guaranteed in most cases. Deliveries of branded items and orders of goods from Asia are exempt from the guaranteed delivery deadlines. The delivery time for these orders is stated in the offer. If the customer wants to be sure about the delivery time before placing the order, the customer should contact AGARIC, d. o. o. or submit a request for an offer. The customer can monitor the status of the order in the My Account tab. The customer will be notified of a new delivery date via e-mail or telephone if an ordered item is currently not in stock. The delivery time for deliveries outside Slovenia depends on the distance.
Withdrawal from the contract
Any complaints must be submitted in writing no later than 14 days after receiving the goods and must be identified by a commission and must include the appropriate minutes. The complaint is not valid for goods with printing if the printing was not ordered from the seller. Errors in the printing of the catalog and the price list may occur outside the scope of our control and are not the responsibility of AGARIC, d. o. o. In the event of a deviation in prices or technical data, the customer shall be notified.
The seller cannot guarantee the re-delivery of that item if that particular item is sold out. Images of items are symbolic. The customer is aware that minor deviations in color, dimensions, or material are permitted.
The decorative material is included in the price of an item, unless otherwise stated. Images of some items are symbolic. In the event that an item runs out of stock, the seller does not guarantee the re-delivery of this item. For all information, contact the company at: AGARIC, d. o. o., Tržaška cesta 23, 2000 Maribor. All disputes under this Agreement will be settled amicably by both parties. If an agreement cannot be reached, the dispute will be resolved by the District Court in Maribor.
The customer is acquainted with and agrees with the General conditions of ordering, payment, delivery, and acceptance of goods.
The images are symbolic and may differ in part from the products themselves.
The concluded contracts are stored in writing at the headquarters of the company AGARIC, Tržaška cesta 23, 2000 Maribor. A copy of the contract may be requested in writing by the client.
Return of the ordered goods
The customer has the right to notify the seller within fourteen (14) days of receiving the goods regarding withdrawing from the contract without having to state the reason for his decision. In order to exercise the right to withdraw from the contract, the customer must notify AGARIC, d. o. o., with a written statement either by email or by post that he wishes to withdraw from that contract. After withdrawal from the contract AGARIC, d. o. o., must return all payments made to the customer. Refunds must be made by the company as soon as possible but or no later than fourteen (14) days after receipt of the notice of withdrawal.
The same means of payment as were used by the customer in the original transaction must be used to refund the payment, unless otherwise expressly agreed upon with the customer. Payment refund may be refused until we receive the return of the goods or until proof is provided that the goods have been sent back, whichever condition is met earlier.
Paragraph 6 of Article 43.d of the Consumer Protection Act in the Official Gazette of the Republic of Slovenia stipulates that if the customer has already received the goods and withdraws from the contract, he must return the goods to the company immediately but no later than 14 days after handing in the notification of withdrawal from the contract. We do not accept cash on delivery shipments.

The costs associated with the return of the goods are borne by the customer. The customer must return the products undamaged, unused, and in the original packaging. He must enclose a copy of the invoice. Clothing, underwear, and accessories that are subject to return MUST be labeled the same as they were at the time of receipt, furthermore, they must NOT show signs of wearing, use or damage. The customer has no right to return the goods in cases where the goods were manufactured according to the exact instructions of the customer.

Information on branding techniques
Pad printing: Due to its ability to print multicolor motifs on three-dimensional surfaces, pad printing is one of the most versatile printing techniques. The design is applied to a metal printing plate via a photographic process, after which it is transferred to the product with a rubber swab. Various shapes of items can be printed with differently shaped pads using this technique and this technique also allows for multicolor printing. Practically all materials can be printed with pad printing as this printing technique is useful for various surfaces and linings. Most gifts on the website are made from synthetic materials for which this printing technique is the most suitable one. Ceramic items cannot be baked at a high temperature when printed with a pad. As a result, this technique does not ensure the durability of the imprint on ceramic items when washing in the dishwasher. Therefore, a transfer for ceramic materials is proposed for this purpose.
Screen printing is a printing technique in which the design is transferred onto a screen which has a light-sensitive top layer. The film prevents ultraviolet light from illuminating the sieve and certain places and, due to the sensitivity of the film, a design is formed. The item you want to print on is placed under the sieve, after which the impression is created by transferring the color through the mesh. Only flat surfaces can be printed on using this technique. Screen printing allows for multicolor printing but this technique is not suitable for textiles and polyester products such as umbrellas, bags, etc.
Screen printing transfer is a printing technique in which a design is printed onto a special paper called a transfer. The rubber pulls the printing paste over the sieve with a pre-coated sample, thus creating the imprint of the sample on the fabric. In principle, only flat surfaces are printed with this technique and it is used for branding textiles, umbrellas, bags, … Most of the products on offer can be printed with screen printing using only one color, and several additional colors can be applied using transfer. Screen transfer is a great way to print very small details. The colors are well absorbed into the base material with the help of an additional glue.
Round screen printing is a screen-printing technique used to print large areas of ballpoint pens.
Digital transfer is a printing technique in which the logo is digitally printed onto a special foil. The foil is then cut into the desired shape and the transfer is then transferred to the product by means of a heat press or a mechanical press. Such a printing technique is suggested for products made from textile polyester. This printing technique allows for multicolor graphics and is generally used to print smaller batches.
Digital label: Digital labels can also be made with the help of the machine. The printer digitally transfers the logo to a self-adhesive foil. If necessary, the label is also computer-trimmed. Trim shapes are only possible on designs that allow “one cut”. The digital cut-out allows you to make stand-alone stickers. The label is glued to the surface of the item after printing and thus personalizes the selected product.
Transfer for ceramics is a printing technique that is also suitable for ceramics since the logo is water and heat resistant (e.g., the print does not wash off while washing in the dishwasher). The logo is printed on the transfer paper by screen printing, after which it is transferred to the desired ceramic item. The item is baked in an oven at temperatures higher than 700 ° C after printing, thus baking the print onto the ceramic. During the baking process, the pores in the ceramic open and absorb the paint. Once the product has cooled, the paint cannot be removed by any of the usual cleaning or washing processes, and the result is a durable personalized ceramic product.
Embroidery is a technique in which a logo is sewn onto a product. It is useful for hats, T-shirts, jackets, bags, and other fabric products. It is considered to be the most enduring personification technique for textile products. The price of embroidery depends on the number of stitches and the size of the logo. As the graphics are more complex, its production requires more stitches, therefore the price of embroidery is higher. The number of embroidery colors does not affect the price and up to 15 different colors can be used. Before the first embroidery, it is necessary to create a program that can also be used for subsequent embroideries of the same logo.
Laser engraving is a technique of engraving by which the logo is ignited into a material with a laser beam. It is a branding technique with which we can personalize items made of materials such as wood, glass, leather, aluminum, plastic. The laser beam is controlled digitally via a computer so the result is an accurate design of the logo with a very high quality. The color of the created logo depends on the base and the lower layers of the workpiece. This technique is mostly used for branding smaller products such as ballpoint pens, key chains, leather diaries, glasses, bottles … The result is nicely branded products and the logo on them is durable.
Blind printing is a branding technique in which a logo with an embossed stamp is printed on the product. This technique can mainly be used on leather products where the final result is of high quality and beautiful. If the customer wishes, foils can also be used to achieve a gold or silver effect or the effect of some other color, and the final product is therefore even more special and visible.
Domin: is a printing method where a multicolor digital label is first printed on a label and then coated with an epoxy resin. It is a combination of the logo print on the label with a two-component epoxy resin that gives the logo a bubble-shaped finish. This gives the graphics a special 3D effect while the epoxy resin protects the graphics below from mechanical damage. This printing technique is suitable for branding small products.
Digital printing is an inkjet technique of printing on products with a flat or a 3D shape. This branding technique allows for almost any products to be directly printed on in very high quality. All printing options are possible, from high-resolution images to simple text, since digital printing can also be used in color printing with the details remaining visible and distinct.
Printed colors may deviate due to the different absorbency of the surfaces.
AGARIC uses the Pantone Color Guide (C) coated scale as the color definition. Customers should follow this color scale when ordering.
The adhesion of paint on metal and chrome products may not be optimal and AGARIC business gifts cannot be held responsible if this occurs. The color print on metal products may be damaged by contact with sharp objects. This is highly likely to occur with metal key rings. Laser engraving is suggested for such cases. In the case of rough textile surfaces, the customer cannot be guaranteed 100% coverage with the screen printing technique. Screen printing transfer is advised in such cases. Round items have a limited print area.
